 BACKGROUND

Americans who live overseas, and military couples who relocate frequently, often have a problem when they need a divorce. They may not be eligible for divorce in the country in which they are stationed. They may not meet the residency requirements of the State where they are living or of any U.S. state. Even if the courts of a foreign country are open, the proceedings may be in a foreign language and the laws difficult to understand. 

Foreign courts may be unwilling to divide property located in the U.S.A. or determine custody of Children who are American citizens. More troublesome, a divorce decree of a foreign court may not be recognized in the United States, if American notions of "due process" were not followed.

Guam, an American territory on the edge of Asia, has enacted laws to assist folks facing this dilemma. Guam laws allow couples to obtain a divorce through the Guam courts, even if the parties have never lived in Guam, if one of the parties can visit Guam for seven days . Guam is an American jurisdiction, with modern courts, applying American laws. The Guam Court System was established pursuant to an Act of the U.S. Congress. All proceedings are in English.
